An aspiring presidential candidate for the National Democratic Congress (NDC) , Dr Kwabena Duffuor has withdrawn an an interlocutory injunction filed against the party's upcoming presidential and parliamentary primaries.
Dr. Kwabena Duffuor filed a case in court on Tuesday, May 9, 2023, for an interlocutory injunction on the NDC primaries slated for Saturday, May 13, 2023.
He cited anomalies with the NDC’s electoral album for his suit, following it up with a petition to the Electoral Commission.
The EC has since announced that it has pulled out of the elections until the NDC sorts out its internal issues.
The suit is to be heard on Friday, May 12, 2023, although there have been assurances from both the National Chairman and General Secretary of the NDC, Johnson Asiedu Nketiah and Fifi Kwetey respectively, that the May 13 elections will come on.
It would be recalled that the delegates in the National Democratic Congress  of Akuapem North constituency in the Eastern Region, have mounted pressure on Dr Duffour to immediately muster courage to rescind his decision to withdraw an interlocutory injunction he filed in court against the party's upcoming presidential and parliamentary primaries slated for Saturday, May 13, 2023.
 
"If the court sees any merit in Dr. Kwabena Duffour suit on  Friday Ma 2023, then this is going  affect the party financially and psychologically.
 
"Apart from the financial loss to the party, it will also affect the chances of Dr. Kwabena Duffour JNR, who’s contesting on the ticket of the NDC at Sekyere Afram plains, the Ashanti Region," the majority delegates of Akuapem  North Constituency noted in a news item captured by Soireenews.com
 
Against this backdrop, they entreated Duffour to withdraw the case and let the elections go on as planned to help bring peace and unity within the NDC which is seeking to win the political power in the 2024 general elections.
 
He indicated that his actions were ostensibly exhibited to create impression that there are division and trouble of the NDC ahead of the 2024 general election.
In papers sighted by Soireenews.com dated May 9, 2023; the suit names five respondents as follows: the General Secretary of the NDC, the Director of the Elections Directorate, fellow flagbearer hopefuls John Dramani Mahama and Kojo Bonsu and the Electoral Commission of Ghana.
According to the writ, the defendants have been commanded to enter their appearance within eight days of being served with the legal documents.
The writ added that failure to comply with the order may result in a judgment being passed in their absence without further notice.
Aside the motion on notice and the statement of claim filed, a number of exhibits are also filed with one of them being a WhatsApp communication with NDC General Secretary, Fifi Kwetey.
The communication is in respect of the failure by the Elections Committee of the party to deliver on its timeline to make the mandated voter list and photo album to be used for the voting available.
 
However, some delegates of Akuapem North Constituency called the former Minister of Finance and Economic Planning to cease fire.
On the financial loss to the party, they pointed out that Dr Duffour should considered that  most of the constituencies have already procured the logistics needed for the elections.
According to them, he also considered that the venues have been paid for, tents have been procured, chairs were paid for already but someone would argue those procured materials could still be used anytime any day.We beg to differ!  
"Few caterers have been contacted already for foods and drinks for the occasion but for the DKD injunction’s suit, all these activities are being thwarted.
"Many of our comrades postponed theirs weddings, funerals,family meetings and more all because of the presidential and parliamentary primaries.
"Others too trekked from both far and near to participate in the upcoming primaries but for the injunction suit, frustrations and mix feelings have become the order of the day.
"I personally think our father and comrade, Dr. Kwabena Duffuor should look at all these parameters before triggering the reliefs from court," a delegate who pleased condition of anynomity noted.
'We’re allowed to eat all fruits but some aren’t expedient for our health,' he added.
According to him, Dr Duffour AHOTOR project is a good move but this singular act of injunction has completely eroded its gains among the rank and file of the NDC.
He asked the moral question that: "Would DKD win the elections if the register is as clean as the garment of pope?
"If no, why all these hustling and bustling.NDC is the name,Winning is our mission.I humbly entreat DKD to withdraw the case and let the elections go on as planned," he concluded.
