Ashaiman circuit court sentences 3 persons for multiple charges of stealing, unlawful entry, causing unlawful damage

The Ashaiman circuit court has sentenced 3 persons for multiple charges of conspiracy to commit crime namely stealing; contrary to sections 23 and 124(1) of the criminal offences Act 1960(Act 29), stealing;contrary to section 124(1) of the criminal offences Act 1960(Act29), unlawful entry; contrary to section 152 of the criminal offences Act 1960(Act 29) and causing unlawful damage;contrary to section 69 of the criminal offences Act 1960(Act 29).

The Ashaiman circuit court has sentenced 3 persons for multiple charges of conspiracy to commit crime namely stealing; contrary to sections 23 and 124(1) of the criminal offences Act 1960(Act 29), stealing;contrary to section 124(1) of the criminal offences Act 1960(Act29), unlawful entry; contrary to section 152 of the criminal offences Act 1960(Act 29) and causing unlawful damage;contrary to section 69 of the criminal offences Act 1960(Act 29).

A1 Sylvester Avayevu Gadzo, A2 Bless Selassie Abala and A3 Perfect Akafui aka Akuvi pleaded guilty simplicita without wasting the time of the court. The court, presided over by His Honour Simon Gaga said, "I have decided to deal liently with them since they are first time offenders. The Judge per the offences on the charge sheet slapped each of the accused persons a deserving sentence. A1 was to 200 penalty units amounting to GHS2,400.00 or in default, serve 6 months in prison custody on count 3 and 200 penalty units or in default serve 6months in prison custody on count 4. A2 was to 200 penalty units amounting to GHS2,400.00 or in default serve 6 months in prison custody on count 1 and 500 penalty units amounting to GHS6,000.00 or in default serve 2 years in prison on count 2 while A3 was sentenced 200 penalty units or in default serve 6 months in prison custody on count 1 and 500 penalty units amounting to GHS6,000.00 or in default serve 2 years jail term. All their respective sentences are to run concurrently. Prosecuting:Chief Inspector Nunoo Mensah for the Republic presented the James Antwi investigated case, told the court that complainant Olivia Akosua Teye is a civil servant and resides at Community 12 Tema. A1 Sylvester Avayevu Gadzo is a squatter and resides at Dawhenya. A2 Bless Selassie Abala is a construction worker and a squatter at Community 25, Tema ,and A3 Perfect Kafui is unemployed and also a squatter at Dawhenya. The complainant has an uncompleted house at Community 25 opposite DPS and has engaged Nobert Senu, a witness in this case as a caretaker. The prosecution told the court that on March 7, 2023, at 33:00 the witness was in his house near the omainanant's house when he saw A2 in the complainant's compound pulling electric wire cables from the ceiling whilst A1 and A3 were spying. The prosecution told the court that the witness became suspicious and confronted the accused persons. The accused persons told the witness they were workers at the site. The witness further confronted the accused persons on how they managed to enter the compound when the gate was locked from the outside. The prosecution told the court that A1 sensing danger scaled the wall after a series of confrontations from the witness, ssignaledA2 and A3, and both accused persons took to their heels. The witness raised an alarm and the accused persons were pursued and arrested and called the police. Accused persons and the witness led police to the scene where it was detected that in the course of forcibly pulling the cables, they caused damage to the 'T N J' ceiling valued at three thousand Ghana cedis (GHS3,000.00). The prosecution told the court that about one coil of 16mm electric cables valued at thirty thousand Ghana cedis(GHS30,000) was retrieved from the accused person's black back bag at the scene. The prosecution said in the course of investigations, accused persons confessed to having committed the crime and after investigations, they were charged with the offences and put before this honourable court.
