Civil engineer, 43, charged found guilty, convicted to 50 penalty units on multiple offenses

The Ashaiman Circuit court has found a civil engineer aged 43 guilty and convicted to a fine of 50 penalty units on multiple charges of careless and inconsiderate driving contrary to section 3 of the Road and Traffic Act(RTA) 2004(Act683) as amended by RTA (Act761) on his plea on three counts.  He would serve a three-month prison term on default.


In the case of the Republic vrs Maxwell Agodey, the accused was further charged with negligently causing harm contrary to section 72 of the criminal offenses Act 29/60 for failing to produce a driving license contrary to section 78(1) of the Road and Traffic Act(RTA) 683/2004.

The accused however pleaded guilty on all three counts and was convicted on his.
Additionally, the accused was ordered to pay GHS 400.00 to the complainant as compensation as he has already paid the medical expenses of the victim.
Presenting the brief facts of the case, Chief Inspector Mohammed Enugah said the accused, driver Maxwell Agodey age 43, being is a Civil Engineer and a resident of Ashaiman Switzerland, was on the 9th day of February 2021 at about 4:00 pm in charge of a KIA Optima saloon car with registration no.DV 2388-2021. Chief Inspector Enugah said the accused was driving from Peaceland heading towards Switzerland, all of which are suburbs of Ashaiman within the Greater Accra Region.

He said upon reaching a section of the road at New York-Switzerland, the accused veered off the road and ran over Priscilla Annor, a four-year girl.
He disclosed that the victim sustained injuries and was rushed to Josa Clinic in New York for treatment.
The victim, Inspector Enugah noted was later transferred to Tema General Hospital for further treatment.
He said that the accused upon interrogation by police could not produce his professional driving license for investigations on request.
He said the accused was subsequently charged for the offenses as stated on the sheet and put before this honorable court.
