Ashaiman circuit court grants 3 suspects to GHS 150,000 and GHS 700,000 bail terms

Prosecution ordered to file witness statement before the next adjourned date of 16-8-23. Prior to granting the bail, the presiding Judge, His Honour Simon Gaga remarked that since the counsel for the accused A1, A2 and A3 prays for bail though the accused pleaded not guilty, and prosecution not oppose to same, and has closed its case, he can't allow the accused persons to be languishing in cells.

Three suspects have been granted bail on separate terms per the charge sheet. Thomas Antwi,38 and Ali Umaru, 36 were both granted to bail in the sum of GHS 150,000.00 whiles John Otu Bush,36 was handled a bail sum of GHS 700,000.00 with two sureties each.

Whilst for A1 and A2, one of the sureties is expected to be justified with a land document, A3 is expected to produce two sureties, all of whom should be justified with landed property.

Thomas Antwi and Ali Umaru were both charged on conspiracy to commit crime namely,stealing, contrary to section 23(1) and 124(1) of the criminal offences Act,1960(Act 29) and other multiple stealing charges whilst the third accused, John Buah was charged with stealing contrary to section 124 (1) of the criminal offences Act 1960(Act 29) and other multiple stealing charges.

Prosecution: ASP Ernest Kwoffie presenting the Number 42008 D/SGT Bosompem Baah Frank Investigative case told the court that the complainant, Elvis Gwira Mensah and Godwin Tweneboah are Operator and Transport Managers of HASS Logistics,Tema. A1, Thomas Antwi , A2, Ali Umaru and A3, John Otubuah are heavy duty drivers residing at Pokuase-Accra, Afienya and Okushibri respectively.

He told the court that during the early hours of July,2023, the complainant's company secured a contract to haul quantity of fertilizers from Tema Port to Yara Ghana Limited Terminal in Community 3,Tema.

The complainant consequently engaged the services of some Tipper truck with Registration Number GN 6540-21, as well as A3 and one other driver,who were also in charge of Howo Tipper Truck with Registration number GT 1574-21.

He told the court that in the course of the work, the complainant detected that on 09/07/2023 at about 2:15 am, A1 and A2's truck which were loaded with 19 tons of fertilizers valued at GHS 152,000.00 with an accompanying way ill from the Tema Port to discharge at the said Yara Terminal diverted same to a place around Adjei Kojo near Ashaiman.

The complainant further detected that A3 and his accomplice driver also diverted 30 tons each of the fertilizer on 06/07/2023, 07/07/2023 and 09/07/2023 valued at GHS 720,000.00 to an unknown destination.

The complainants made a case to the police and the accused persons were arrested. During investigations, the accused persons admitted the offence and led police to an uncompleted warehouse at Adjei, were they claimed to have sold the stolen fertilizers to one Boga at GHS 45,000.00. Police found evidence of same left overs of the fertilizers on the premises of the said Boga, who is yet to be arrested.

The accused persons were charged with the offences and arraigned before the honourable court, whilst efforts are underway to arrest their accomplices.
