Principal and accredited elders of Kwartei Royal Family of the Gbawe Stool under the Asene Traditional Area in the Greater Accra Region have described as a complete lie and misguided of the publication by the chiefs and elders of Akumajey Traditional Area that an Accra High Court has entered ruling in favor of the elders of Akumajey against the Gbawe Kwatei Family over the custodial ownership of the customary land boundaries.

A couple of days ago, there have been reports in sections of the media for which the chiefs and elders of Akumajey Paramount Stool in a press conference, referred to an Accra High Court judgment that gave them authority over Mallam market, Dansoman, Odonkor, and other areas in Accra, and cautioned the elders of the Gbawe Stool to act accordingly.

In that report, the chiefs and elders of Akumajey noted that “Barely a month ago, the High Court gave judgment in favor of the Akumajey Paramount Stool against the Gbawe Family over customary boundary lands belonging to the Akumajey Paramount Stool of which entry of judgment has since been served on the Gbawe."

The report noted that the court has ruled that the chiefs and elders of the Akumajey should go back and reclaim these lands which are on the customary boundaries between the Akumajey Paramount Stool and the Gbawe Stool.

in the report, the Akumajey Paramount urged private property owners, dwellers, and estate developers on these customary land boundaries to exercise patience, and assured that all uncertainties surrounding the true ownership of the land would soon come out because they have been empowered by a court ruling to regularize all land that belonged to the Akumajey stool.

Following this development, the Akumajey paramount stool issued a warning to the Gbawe stool family to stay off their land.

They further referenced a court judgment that gave them authority over the said land and cautioned Gbawe to act by the judgment.

But in a quick rebuttal at a crowded press conference in Accra on Wednesday, August 9, 2023, which was addressed by the Secretary of Gbawe Kwatei Family, Mr. Solomon Nii Afutu Quartey, the family cleared the uncertainties surrounding the true ownership of Mallam Market, South Odorkor, Gbawe Gonn Kpataa (Mataheko ), Gbawe Kpeehe, Gbawe Okoefioman (South Odorkor), Gbawe Koenyonaa/ part of Dansoman and Gbawe Otojor.

Setting the records straight and unveiling the relevant information which has legally been endorsed, Mr. Quartey indicated that the chiefs and elders of Akamajey have "twisted facts and misinformed the general public, stressing that the Kwartei Royal Family are the rightful owners of the lands in the aforementioned areas in Accra.

Mr Quartey provided documentary proof which was in the possession of this journalist to support his claim that they have won several judgments against the elders of Akumajey Paramount Stool, citing an instance for which the Paramount Chief of Akumajey Traditional Area, Nii Ayikai III was nearly jailed for committing which amounts to contempt in court.

He referred to circumstances on how the chiefs and elders of Akamajey Paramount Stool have earlier stolen their lands in some parts of Accra and resold these lands to innocent lands developers who later came to the Kwartei Royal Family of Gbawe Stool for lawful regularization of their lands title documents.

He stated that their lawyers are working on the matter to help them take legal action against the Akumajey Paramount Stool for trespassing on the lands which situation has created confusion and tension in Accra.

In this regard, he stressed that the Gbawe Kwatei Family urged the general public to Disregard Akumajay Stool’s claim of having procured judgment against the Gbawe Kwatei Family.

"The Gbawe Kwatei Family wishes to draw the attention of the general public to a recent publication by the Akumajay Stool in which the Akumajey stool made several spurious statements including “Court declares Akumajay Stool owners of Mallam Market, Dansoman and other areas in Accra.”


"We refer to the ruling of the Accra High Court (Land Division 5), dated 18th July 2023 and delivered by Her Ladyship, Justice Rita Abena Abrokwah Doku (Mrs.) in the suit “SUIT NO: LD/09/02/2018 - Nii Ayikai III vs The Regional Lands Officer and Nii Adam Kwatei Quartey (Head of the Gbawe Kwatei Family) and respond to the false claims of the said Stool as follow," he noted 

According to the family secretary, the 
Honorable Court through Her Ladyship, Justice Rita Abena Abrokwah Doku held that the “Order of Mandamus” granted by the Accra High Court (Land Division 1) on 10th August 2016 constituted a breach of natural justice against the Akamajay Stool as they were not adequately informed of the trial, and is accordingly set aside on same grounds.

He explained that the MANDAMUS ORDER was against the Regional Land Officer of Lands Commission to comply with Justice Victor Ofore's judgment dated 11th July 2006 Suit No SUIT NOs: L215/001 and AL//23/2003. 

He argued and stressed that the Akamajay Stool HAS NOT WON ANY CASE AGAINST THE GBAWE KWATEI FAMILY regarding any disputed land or lands.

According to him, the general public is urged to completely disregard the false claims as merely a creation of a group of confused minds.


For the records, Mr. Quartey provided documentary proof to back his claim that they are cases between the Gbawe Kwatei Family and the Akumajay Stool in which the Gbawe Kwatei Family’s undisputed ownership of several portions of lands being claimed by the said Stool which were affirmed by the Court.

Based on the above, the Gbawe Kwatei Family hereby urges the general public to completely disregard the spurious claims by the said Stool and treat their publication with the contempt it deserves. 


"We further issue a strong word of caution to the general public to desist from dealing with the Akumajay Stool on any land business along the areas mentioned in their misguided publication. 

"For the avoidance of any doubt, the areas as follow, Mallam Market, South Odorkor, Gbawe Gonn Kpataa (Mataheko), Gbawe Kpeehe, Gbawe Okoefioman (South Odorkor), Gbawe Koenyonaa/ Part of Dansoman Gbawe Otojor," they warned.

He also called on the President, Nana Addo Dankwa Akufo-Addo, and the Chief Justice to ensure that due process is followed and the rule of law is allowed to work.

They stressed the fact that the family will implement any strategy necessary to reclaim their lands.
