She argued that due process was not followed and that the Tanzanian government should be held accountable.

Judge Phillip Loubser ruled Dr. Magudumana "was aware of the charges that would be leveled against her in South Africa," but recognizing that some aspects of the arrest were faulty.

She gave permission for removal. I believe the application will fail. With costs, it is dismissed," he declared.

Dr. Magudumana will remain in custody and continue to fight a number of charges stemming from his alleged role in aiding Bester's prison break in May.

Her legal team has stated that they will analyze the verdict and follow Dr. Magudumana's directions on how to proceed.

Her attorney stated, "An appeal is not off the table."
