Ashaiman Circuit Court Sentences Tipper Truck Driver to GHS2,400.00

The Ashaiman circuit court has found guilty, convicted, and sentenced a tipper truck driver to a fine of 200 penalty units amounting to GHS2,400.00 or in default serve a jail term of 3 years in hard labour on count 1.

The Ashaiman circuit court has found guilty, convicted, and sentenced a tipper truck driver to a fine of 200 penalty units amounting to GHS2,400.00 or in default serve a jail term of 3 years in hard labour on count 1.

On count 2, the accused person Richmond Adjetey was sentenced to 100 penalty units amounting to GHS1,200.00.

All sentences are to run concurrently. The accused, Richmond Adjetey was charged with two counts of careless and inconsiderate driving contrary to section 3 of the Road Traffic Act, 2004(Act 683) as amended by the Road Traffic Amendment Act, 2008,(Act 761) and negligently causing harm, contrary to section 72 of the criminal offences Act 1960 (Act 29).

The presiding judge, His Honour Simon Gaga upon receipt of the docket forwarded to the Attorney General for advice, sentenced accordingly.

Prosecuting; Chief Inspector Samuel Aperweh presenting Inspector Peter Banaba to in charge case brief facts told the court that the accused person, Richmond Adjetey is a driver who lives in East Legon, Accra.

On March 2022 at about 2:00 pm, the victim Avorgbedor Vincent Agbeko, a motorbike rider was in charge of a Royal motorbike registration number M-21-GW 4964 riding from Apollonia towards Katamanso for delivery service and upon reaching a section of the road at Kubekro number 2, the accused person who was then the driver in charge of a Howo Tipper Truck with registration number GT 3639-21, driving from Katamanso to Appollonia, without due care and attention to other road users, veered into the opposite lane and collided with the victim's motorbike.

The victim sustained serious injuries and was rushed to Trinity Hospital for treatment but was pronounced dead on arrival.

After post-mortem, the body was released to the relatives for burial. The accused person was arraigned before this court whilst a duplicate case docket was forwarded to the Attorney General's Department for advice.

Police received the advice from the A-G Department dated September 18, 2023, signed by Natalie Korkor Hamond, Assistant State Attorney following which the accused person was charged.
