Managing Director (MD) for Top Kings Enterprise Limited, Dr Emmanuel Kwame Danso,has questioned the competence and devotion of Ghanaian based Italian, Baron Fiore Ernesto Taricone, as successful business mogul doing businesses in Ghana.
Addressing a crowded press conference held in Accra on Friday February 3, 2023, Dr Danso
disclosed their perception of Baron Fiore Ernesto Taricone as someone who ‘makes trouble who is creating insecurity in the country.
 
Dr. Danso on behalf of the management of Top Kings Enterprise Limited questioned the commitment of Baron Fiore Ernesto Taricone challenging him to come out and declare what he has done for the people in Ghana as well as the whole mother Ghana.
 
Dr Danso could not fathom why the police officers of Ghana Police Service would continue to be given unflinching support to this foreign national to use the land-guards to visit severe  attacks to the lands developers who bought lands from the company in its East Legon Topkings Village site and that "if he was arrested and brought before the law, the senior police officers would be saying that Baron Fiore Ernesto Taricone has done a lot to help the mother Ghana."
 
"Why is it that the senior police officers would
keep praising Baron Fiore Ernesto Taricone  but what has he done for the for the mother Ghana party? Baron Fiore Ernesto Taricone He should come out with it. We know those foreign nationals who had done a lot to help mother Ghana," Dr Danso noted
Dr Danso accused the police officers of Ghana Police Service, particularly the senior personnel stationed at the East Legon Police Station in Accra for supporting the Ghanaian based Italian, Baron Fiore Ernesto Taricone, the owner of Trasacco Group to disrespect the rule of law in the country.
According to Dr. Danso, the senior police officers of the station allegedly covered up many wrong doings of Baron Fiore Ernesto Taricone, saying that he didn't have respect for the rule of law in Ghana.
Dr. Danso pointed and that the police officers  usually made owner of the Trasacco Group goes scot-free anytime he unlawfully uses the notorious land-guards to demolish the building structures of the land developers who legally and genuinely bought lands from the Top Kings Enterprise in its Top Kings Village site in East Legon in the Greater Accra Region.
He cited an instance where they spotted  Baron Fiore Ernesto Taricone sitting on the executive chair in the office of the commander of the East Legon Police Station in Accra to write his police caution statement when he was invited by the police officers for hiring the notorious land-guards to demolish or cause damages to the building properties of their clients on the project site of Topkings Village at East Legon.
"When we report our cases to police officers at the East Legon Police Station Central East Regional, they will tell us categorically that they cannot follow up the case because there are orders from the power of above that we should not moved to go and effect arrest on the project site of Topkings Village at East Legon, so these land-guards took advantage  of this and  to always come to our lands to demolish the building structures of our clients at Topkings Village site in East Legon. But we are sending these warnings to the leader of these land-guards, Ernesto Taricone that we would use our last blood to protect our lands we bought from the Nungua Stool at East Legon," Dr Danso vowed.
Dr Danso made these foregoing statements when he was addressing a crowded press conference in Accra on Friday February 3, 2023.
He was responding to the current press conference held by the Empire State Builders, a subsidiary of real estate giants Trassaco Group, for which the company has issued a two-week ultimatum to the government of Ghana to intervene in what it describes as an attempt to convert some parcels of land it has legally acquired.
 
The company at a press conference held at its head office in Accra on Tuesday, February 31, 2023, explained that Topkings Enterprises Limited with the help of “land guards (which is illegal), some members of the Nungua Stool and men wearing the Ghana Armed Forces uniform, have trespassed onto the land of Empire Builders Limited.”
 
The company added that Topkings with quasi security forces “...brutally attacked the company’s workers; demolished the company’s property; cleared part of the company’s land, and is preparing to sell the company’s land to unsuspecting members of the public.”
 
This development according to Empire Builders is on the back of a long-standing dispute between the two companies over the land in question located at Adjiriganor in the East Legon enclave of the Greater Accra Region.
 
Briefing the media about the history of the said land, the company said it acquired the land as far back as 1977 when the founder of Empire Builders, Baron Fiore Ernesto Taricone, acquired it from the Nii Ashong Mlitse Family of Odaitei Tse We.
 
The company said it had been developing the land without any issues until 1998 when it noticed encroachment activities on the land by Topkings Enterprises Limited.
 
A legal battle between the two companies which commenced at a High Court in 1999, ended in a Supreme Court appeal which according to the company, saw the court affirm its interest in the said land, albeit with 22 and 32 acres being allocated to Topkings by the court.
Despite the ruling of the court however, the company belonging to the Trassaco group said Topkings Limited through the support of some individuals have trespassed into its portions of the land.
 
“Every effort of Empire Builders Limited to protect its land has been met with brute force from these men parading as soldiers,” Public Relations Consultant of Empire Builders, Dr Kwame Owusu Danso told the media on Monday.
 
He noted that the activities of the encroachers is putting the jobs of some 4,000 employees, some of whom have been victims of the brutality, at risk.
 
The workers are therefore appealing to the government and all relevant security agencies including the National Security to intervene in the matter.
 
According to workers, they will be left with no option but to stage a public protest to register their sentiments should the state fail to intervene in the matter.
 
“It appears that Topkings Enterprise Limited is operating with the support of some high-level authority, which accounts for the use of soldiers in the land guard activities. Why are military men on the ground able to drive the police away whenever the police try to intervene and maintain peace? Who is giving the orders to the soldiers of the Ghana Armed Forces to engage in these land guard activities? We demand that the soldiers are immediately withdrawn from the land and restrained from committing further activities,” the statement stressed.
 
In a counter press conference, Dr.Danso rubbished the claims by the Transaco Group the Topkings Enterprise Limited used the military personnel to brutally attack the company’s workers; demolished the company’s property; cleared part of the company’s land, and is preparing to sell the company’s land to unsuspecting members of the public.
 
He stated that the soldiers were deployed to the lands to ensure that there was no fight between the two parties in lighting over the land.
 
"The public is advised to ignore the press conference organised by workers of Empire Builders led by their Manager Ian Morris, during which they alleged an unlawful takeover of their land by Top Kings Enterprise Ltd with the assistance of the military and arrogantly issued a 2-week ultimatum to government to intervene in the dispute with Top Kings Enterprise Ltd. failing which it would take the law into its own hands. 
 
"Top Kings was dragged into a protracted litigation by Empire Builders spanning a period of 22 years from the High Court through to the Supreme Court with Empire Builders losing at each stage of the litigation," Dr Danso stressed. 
Not satisfied with the outcome of the Supreme Court’s decision, Dr Danso noted that Empire Builders Ltd commenced a fresh action at the High Courts at Adenta and Accra against Top Kings Enterprise in 2021, alleging that Top Kings is taking land not covered by the 1998 to 2020 suit which ended at Supreme Court.  
The 2021 suits too were dismissed and a further appeal to the Court of Appeal suffered the same fate. 
  
Throughout this lengthy dispute, according to him, the Empire Builders Ltd has engaged all the topmost law firms in Ghana with 3 of the most prestigious law firms representing them at the High Court at the same time.  
He pointed out that the Empire Builders Limited still has the financial clout to employ all the top lawyers in the country to seek legal redress in Court for the allegations made at the press conference.   
"Why is Empire Builders Ltd not engaging lawyers to bring action against Top Kings Enterprise but rather appealing to the President to intervene?   
 
Responding to the facts from the press statement by Empire Builders, he pointed out that the litigation had always been that the land in question is owned by Teshie and not Nungua. 
According to Dr. Danso, the land in dispute at the beginning of the suit was covering over 1800 acres, adding that "It will interest the public to note that all the above were considered at the High Court level through to the Supreme Court, as copies will be made available to the public and press gathered here. 
Conflicting to their paragraphs 9 & 10, purporting to leases granted them by government and Nungua Stool, while the same land was being litigated in the Appeals Court and further to the Supreme Court, Dr Danso noted that "we want the public to note that we never pronounced Empire Builders as owners of 402 acres. 
"Permit me to read from the last paragraph of page 15 of the Appeals Court judgement as we share copies to the media and general public. It is of great importance for the general public to note that as we share various documents with the press and public gathered here, even after Supreme Court, Empire Builders/ Trassaco filed 2 separate suits, one in the Accra High Court (Land Court 10) and the other at the Adenta High Court.  
"After their press conference on 31st January, at about 3.pm on Thursday the 2nd of February 2023, Empire Builders Ltd lead by its manager Ian Morris and his brother, assembled a group of hoodlums and land guards at the Trassaco Estate, armed the thugs with automatic rifles, mobilized a couple of excavators and went on a demolition spree of properties and fence walls built be grantors of Top Kings Enterprise Ltd. on its land at Borteyman/Adjiriganor. This operation was led by one self-styled Dr. Botchway of CPS Security. A case has been lodged at the East Legon police station following the incident. Our lawyers have also been instructed to pursue other appropriate legal remedies for the unlawful conduct by Empire Builders Ltd," he noted.
He asserted that these activities of Empire Builders have been petitioned to the National Security, NIB, Military Intelligence etc. 
"We want to waive the fear of all property owners to freely deal with Top Kings Enterprise Ltd and the Nungua Stool as the rightful owners of the land in question. We want all to note that the property is plotted in the name of Top Kings and the Stool. 
Dr Danso indicated that the property owners within Trassaco Estate should not fall victim to the palpable lies of Empire Builders, they should take steps to confirm the true ownership of the land on which they have their buildings and take appropriate steps to see the Nungua Stool for regularization.
