Supreme Court to decide whether or not Jean Mensa will testify today

Mahama’s legal team has argued that the EC Chairperson, ought to take the stand because her testimony is pivotal to the issues set out to be determined in the petition.

The Supreme Court today give its ruling on the joint application by the Electoral Commission (EC) and President Akufo-Addo not to present witnesses in the ongoing election petition.

The two respondents on Tuesday made the application to the apex court arguing among other reasons that the petitioner had not sufficiently discharged on his obligation to prove the issues raised for determination.

Lead counsel for the EC, Mr Justin Amenuvor, told the apex court that his client, (EC), which is the first respondent has decided not to adduced any evidence and therefore the court should decide the petition filed by Former President John Dramani on its merit.

“It is our case that we would not wish to lead any further evidence, and therefore we are praying that this matter proceeds under order 36 rule 43 and C.I. 87 rule 3 (5) and we hereby on that basis, close our case.”

Lead counsel for President Nana Akufo-Addo, Akoto Ampaw also argued that the petitioner has not been able to make a solid case in court hence such decision.

But Mr. Mahama’s legal team has argued that the EC Chairperson, in particular, ought to take the stand because her testimony is pivotal to the issues set out to be determined in the petition.

However, the EC’s lawyers maintain that the witness need not be considered as evidence and thus does not necessitate a cross-examination.

President of the court, Chief Justice Anin-Yeboah had adjourned the ruling on the application to today.

The court is expected to sit at 9.30 this morning to deliver the much-anticipated ruling in the petition.
