Supreme Court Judgment favours Nungua Stool and Top Kings-Council declares-Calls for the protection of leadership

The Nungua Stool Council in a press  release has stated that, after 21 years of protracted litigation between Empire Builders vs. Top Kings Enterprise Ltd & 4 Others, the Supreme Court, which is the highest court of the land, entered Judgment in favour of Top Kings and its grantors; the Nungua Stool.

The Nungua Stool Council in a press  release has stated that, after 21 years of protracted litigation between Empire Builders vs. Top Kings Enterprise Ltd & 4 Others, the Supreme Court, which is the highest court of the land, entered Judgment in favour of Top Kings and its grantors; the Nungua Stool. 

The statement pointed out that, considering  the level of impunity orchestrated by Ernest Taricone and his cronies and the brazen attacks on personnel's of both the Nungua Stool and Top King Enterpris, humbly ask for the protection of the leadership of Nungua Stool and the managemer".

The purpose of the  press statement according to the Council, is to set the records straight and reiterate that, the whole enclave known as the Trassaco enclave belongs to the Nungua stool. 

The land in question it came out, forms part of the Nungua Stool Land and same has been affirmed by the Supreme Court in the case cited supra.

"Contrary to publications, both online and traditional newspaper articles suggesting that th
leadership of the Nungua Stool and Top King Enterprise Ltd have hired land guards and thugs cause mayhem on the land, we wish to emphatically state that they are all blatant lies".

The statement indicated that, Supreme Court adjudged the Nungua Stool to be the true owners of the land describing it as situate at Adjiringano - North, Accra comprising an approximate area of 465 acres of which Empire Builders acquired no interest whatsoever in the land known as the Trassaco enclave.

"After judgment was delivered against Empire Builders by the Supreme Court, the owners of
Empire Builders Ltd, namely; Ernesto Taricone and Morris Ian (both Italian nationals) being
disgruntled by the decision of the Supreme Court have taken matters into their own hands to
disrupt the peaceful enjoyment of the judgment by the Nungua Stool and Top Kings Enterprise Ltd in clear breach of the decision of the apex court of this country".

The above-named persons the Council mentioned, started by petitioning the Ghana police with fabricated stories as to the Ghana police, and the Police became aware of the ownership of the land.

The release averred that, during investigations, Supreme Court decision and accepted/granted to provide security to the Nungua Stool to take possession of the land. "To affirm the ownership of the Nungua Stool and Top Kings Enterprise Ltd., the Attorney General, who is the principal legal advisor to the Government wrote to the Inspector General of Police and directed him to desist from interfering with Nungua Stool and Top King's quiet enjoyment of the land".

It continue that after exhausting possible avenues available to them, the owners of Empire Builder's Ltd, particularly, Ernesto Taricone and Morris lan resorted to illegal means such as the use of land guards and armed men to disturb the quiet and peaceful enjoyment of the land by Top King Enterprise Ltd. "One such incident occurred on the 21" of March, 2021 at the ungodly hour of 1am when Ernesto Taricone and Morris lan sent armed men illegally onto the land and beat up the site supervisors placed on the land by the leadership of the Nungua stool and the management of Top King and then went ahead to demolish the fence walls on the land".

The statement further stated, "In  light of their blatant disregard for law and order in the country and their attitude of openly declaring that they do not have any modicum of respect for the administration of justice in Ghana by repeatedly going on the land to do the very thing they have been restrained from doing, Top King Enterprise Ltd as law-abiding citizens instituted contempt proceedings against Empire Builders Limited and Ernesto Taricone at the High Courts, Tema and Adenta respectively and for which a ruling is pending in the High Court, Adenta".

The Council said, not fazed by the contempt proceedings and in pursuance of their continuous willingness to wreak havoc in the enclave, on 31st July 2022, Ernesto Taricone and Morris Ian again sent armed men onto the land around 2am with the instructions to shoot and kill any person they see working on the land. However, by the diligent and industrious work of the security placed on the land by leadership of the Nungua Stool and Top King Enterprise Ltd, these armed men were arrested. 

"A Mossberg pump action gun and twelve (12) rounds of ammunition were retrieved from the suspects Akrubilla Annanfo and Razak Seidu and they were subsequently handed over to the Accra Regional Police Headquarters".

"Unperturbed  by numerous arrests of their thugs due to their disregard for the lives of the citizens of this country, on 24th August 2022, Ernesto Taricone and Morris lan hired a different set of thugs to invade the land and beat up the workers of Top Kings Enterprise Ltd. Only the swift intervention of the Police prevented bloodshed by the thugs hired at the enclave. These thugs were then arrested and together with the other suspects and their chief orchestrator, Morris Ian, were arraigned before the Circuit Court, Accra, facing four (4) separate charges for their activities on the land on Friday, 26 August 2020. The suspects numbering & were denied bail by the presiding judge and adjourned the case to, 30 August 2022 for continuation and on which said date, the court did not sit. In light of that, the case was adjourned to Friday, 2nd September, 2002".

 "The fabrications it was revealed, made by Ernesto Taricone and his cronies to cause fear and panic within the vicinity saying, it does not make any sense for a victorious judgment creditor to employ land guards a thugs to ward off trespassers on its land. These activities are done by the agents of Emp Builders to prevent the Nungua Stool from asserting their ownership on the land.

"It is shocking how an Italian can migrate from his country, come to Ghana and have no reg whatsoever for the laws and judicial system in our Country and yet he is allowed to roam in
country freely without any care or worry. We wish to put on record that no Ghanaian can eve
foot in Italy and act with impunity and disregards for the Italian laws without facing the stric
of sanctions or imprisonment".
