Dirty Plot To  Malign Ekow  Ewusi Land  Editors  -Of Joy FM, The Inquisitor And Herald In Big Trouble

Former Central Regional Vice-Chairman of the New Patriotic Party (NPP), Mr Horace Ekow Ewusi, has threatened to sue the News Editor of Multimedia Group Joy Fm, The Herald and Inquisitive Ventures publishers of The Inquisitor for publishing the scandalous stories about him which ought to defame his personal reputation.

The Inquisitor newspaper in its Friday July 1, 2022 edition with the headline captioned: ‘’ Seized Oil On MV Sirius Voyager; Ekow Ewusi Pops Up In Strange Auction," published this story to defame the hard working businessman cum politician.

This notwithstanding, the Herald Newspaper in its front page publication on Monday, 4th , 2022 edition captioned the headline that " Ekow Ewusi Fights NPA Over Contaminated Fuel Smuggled Into Ghana."

Also the Joy FM in its headline story carried by the host of the News and Current Affairs Rogramme "Top Story," Mr  Mr Evans Mensah which aired on Thursday, 30th June 2022 claimed that National Security had impounded a vessel carrying smuggled contaminated fuel with the likely involvement of a senior NPP official, Mr Ewusi.

However, Mr Ewusi issued the threat in a rejoinder signed by his solicitors with the MORGANBAUERS Y.E.S, the Legal, Human Resources (HR) and Corporate Advisory firm in Accra and addressed to the three media houses in Accra.

“Any attempt to spread falsehood about my client, Mr Ewusi will not be countenanced. Should that be the case, Mr Ewusi will not hesitate to seek legal redress to serve as deterrence,” the letter sighted by Soireenews.com threatened.

The three media houses promised to reveal details of the scandal in its subsequent editions.

But Mr Ewusi in the strong worded rejoinder disputed the publication of the media houses  as according to him, is unaware of any scandal.

He stressed that it is true that he attempted to seize the bad fuel and sell it on the market to recover an alleged debt the owner of the cargo had to settle by court order.

Mr Ewusi through his solicitors has given seventy two (72)  hours of ultimatum to the managements of the three media houses to react the publication and render unqualified apology to Mr Ewusi and that failure to do so would compiled him [Horace Ekow Ewusi] to sue them in the law court for defamation of character.

"In the meantime, to affirm the right of our client against your inaccurate and defamatory publication we demand that you confirm within 72 hours of receipt of this letter, an apology and retraction of the publication with the same prominence as the original story.

"Kindly note that failure to do so will leave my client with no option but to pursue all available options and remedies under law," parts of the rejoinder reads.

Dear Sir,

RE- RETRACTION AND APOLOGY OF DEFAMATORY STATEMENTS AGAINST EKOW EWUSI ON TOP STORY (THURSDAY, 30TH JUNE 2022)

We act as Solicitors for Horace Ekow Ewusi of Accra (hereinafter referred to as "our Client") and write on his behalf on the above subject matter pursuant to his instructions.

Our attention has been drawn to a headline story carried on your news and current affairs program "Top Story" which aired on Thursday, 30th June 2022.

In the said programme your host Evans Mensah claimed that National Security had impounded a vessel carrying smuggled contaminated fuel with the likely involvement of a senior NPP official.

Accordingly, we write to formally correct certain inaccuracies contained in the said story and demand a retraction and apology.
Permit us to point out clearly that your story line indicated above wrongly associates our client to an alleged case of smuggling contaminated fuel into the country. It further went on to state that certain "suspicious characters" were involved in the alleged smuggling of the petroleum products.
Consequently, we state that same is false and defamatory.

The truth of the matter is that our client is not a party to the substantive matter in the case of Humano Energy Limited v. Clement Alexander Clements at the High Court, Tema as your story sought to portray that Ekow Ewusi had filed a writ against the National Petroleum Authority (NPA).

You further inaccurately indicated in the story that our client was the Plaintiff/ JudgmentCreditor in whose favour the judgment had been delivered on a claim for the recovery of monies owed him by the Defendant/ Judgment-Debtor.

Our client as the Auctioneer had his Mart known as Coastal Mart appointed by the Registrar of the High Court, Tema to oversee the conduct of the auction of assets of the Defendant/ Judgment Debtor in execution of the judgment of the court.

As the person, entrusted with the sale by auction of the assets attached in execution of the judgment to satisfy the judgment debt, our client in line with his mandate only sought to protect and preserve the authority of the court when the National Petroleum Authority (NPA) through its officers assisted by some officers of the Western Naval Command sought to undermine the courts authority by offloading the petroleum products from the vessel before the stay of Execution filed by the NPA itself could be heard and determined.

In the circumstances, it is clear that a little effort into getting the true facts of the matter would have been appreciated by all and more particularly your listeners.

Consequently, we wish to place on record that your storyline together with the story was reckless, malicious and defamatory of our client.

It is apparent from, among other things, the timing of the story, that it is nothing more than a politically-motivated effort to tarnish our client's reputation by scandalizing him in the public space through your program on Thursday 30th June, 2022.

Indeed, in trying to unravel the identity of our client to your listeners, you deliberately related him to the "Galamsey scandal" involving the former Minister of Environment and his suspension as the First Regional Vice Chairperson of the New Patriotic Party (NPP) in the Central Region.

Accordingly, our client deems these statements made as deliberate attempts to court disaffection, opprobrium and ridicule from the public against his person and in the eyes of right-thinking members of society and his business partners.

From the foregoing, we hereby demand that you immediately cease any further publication of the story involving our client as the matter is before the High Court in Tema and issue a full and immediate retraction and apology with the same prominence within 72 hours.

Kindly note that failure to do so will leave my client with no option but to pursue all available options and remedies under law.
